These Terms and Conditions (hereafter referred to as the "Agreement") are an agreement between you, this AdviceReady.com website (hereafter referred to as the "Website"), the members of this Website (hereafter referred to as the "Member" or "Members"), and our company including, but not limited to, its officers, directors, shareholders, employees, subcontractors, agents, affiliates (hereafter collectively referred to as "We" or "Us" or "Our"). The scope of this Agreement does not cover any agreements that you make between the knowledge provider or any third-party provider (hereafter collectively referred to as the "Experts") and yourself. Therefore We are not and cannot be held responsible and/or liable for the agreements between you and the Experts.

By using this Website, you consent to the Agreement set forth in this page. If you do not consent to this Agreement, or you believe or are unsure that any parts of this Agreement may not apply to the jurisdiction in which you reside or access this Website, We kindly require you to cease using and then leave this Website and erase any data that link or belong to this Website or the Experts immediately. This also means that you cannot and shall not use this Website in any way including but not limited to advertising, soliciting, offering or buying services through this Website. Under no circumstances shall this Website be liable or responsible for the result of you not agreeing with the Agreement.

Parts or the whole Website, including this Agreement, may change at any time at our discretion. We kindly require that you review this Website and its Agreement periodically because your continued access of this Website is deemed as your continued acceptance to the Agreement, including the changes incorporated in it.

By accepting this Agreement, you also agree to the use of electronic communication methods that We provide including, but not limited to, emails, this Website's webpages, forums, whiteboard and chatting services. You concur that this Agreement, notices, disclosures and other communication that We employ satisfy any legal requirement and legally binding as those in writing. you will take all the protection measures to protect your identity including but not limited to your password, your credit card number, bank account details, address, telephone from anyone from this Website or from outside this Website.
you will be responsible for your actions or for accepting any offers or results from the Members. Under no circumstances will this Website be responsible or liable for any direct, indirect, consequential, incidental or any other nature actions that you take or consequences you receive for accepting the offers from the Members.
the Experts, the courses and the Members are not controlled by us and therefore this Website is not responsible or liable for any actions that are taken by the Members or for the accuracy, quality, quantity of the Experts, or the advice and contents of the courses that are given by the Experts. Because of this nature, We also cannot provide any guarantee of any kind that the Experts or the people who consult in this Website will perform their obligations.
you will pay the fees to this Website if this Website instructs you to do so, for example when you consult the Experts or taking a course. The fees will be displayed in the Website before you enter into any commitment to this Website or to the Experts. Unless otherwise stated, all payments are due in United States Dollars (USD) and should be paid in advance of all transactions. Unless stated otherwise, this Website does not offer money-back guarantees of any kind.
this Website does not charge you for being a Member, depositing the money or consulting the Experts. You are free to deposit the money or withdraw your money at any time after a certain period that We deem necessary to hold your money in order to prevent frauds or chargebacks. However, withdrawing money that has previously been deposited to this Website incurs a withdrawal charge. This charge is described in the fees section. If required by applicable laws, you will also pay your taxes or duties imposed upon this transaction by the applicable jurisdictions.
you will not divulge or exchange contact information or any other information which permits Members and Experts to make contact other than via this Website's platform or other personal details among the Members. This activity is strictly prohibited and constitutes a material breach of this Agreement. All communication between Experts and Members must be carried out via this Website's platform. Every person who contacts an Expert via this Website's platform (including, among all, by voice, chat, email or other medium) will be considered to be a Member.
you will use this Website legally and for lawful purposes only. You do not restrict, prohibit, inhibit Members from using the Website. You will not access the Website by any means other than through the interface that is provided by us for use in accessing the Website. You will not take any actions which may undermine, disrupt or manipulate the integrity of this Website. You will not interfere with or disrupt this Website or the servers or networks connected to the Website.
you do not act, promote, post, upload, transmit or make available through this Website any material, information or statement or any other kind of matter that are unlawful, harmful, threatening, abusive, stalking, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, fraudulent, racially, ethnically, or otherwise objectionable, including but not limited to any material that encourages conduct that would give rise to any liability or otherwise violate any applicable local, state, national, or international law, statute, ordinance, rule, regulation or ethical code.
you will not infringe, reproduce, duplicate, copy, sell, resell, reverse engineer, exploit, upload, post, e-mail, transmit or use, for any commercial purposes, any portion of the Website or access to the Website including but not limited to all content, designs, text, graphics, compiled software, underlying source codes, and other graphic arrangements together with the compilation, the collection, arrangement and assembly without Our express written consent approval.
you will not infringe, reproduce, duplicate, copy, sell, resell, reverse engineer, exploit, upload, post, e-mail, transmit or use in any way in this Website, any materials from other sources that are protected by intellectual property rights or in any way private or protected without written consent from the legal owner. this Website's billing system is not error-free, and We shall not be liable for any problems, miscalculations or malfunctions in processing the fees or other payments. If a Member thinks that a mistake has occurred he/she must send his/her complaint to Us within 30 days of discovery of such mistake. If for any reason the Member has not paid the fees or has paid but has later charged back such payment, no fees will be paid to the Expert for that transaction and if the money has already been sent to the Expert, the Expert is required to repay this amount to Us, and We have the right to deduct this amount from the Expert's account or from the following payments to be made from this Website to the Expert.
For Experts: if you are an Expert, you agree that the fees will be deducted from any Expert fees or other payment that will be received by Us and credited to the Expert's account immediately upon receipt of such payment less the applicable fees as described in the fees section and applicable tax or withholding taxes (if there is any). You authorize Us to withhold, at our discretion, payments to you paid by the Member(s) of certain amounts until adequate time has passed to ensure that the payment will not be disputed by the paying Members or charged back, or, if We reasonably believe that fraudulent activity may have occurred in connection with payment, until We are able to verify that no such activity has occurred. If required by applicable laws, you will also pay your taxes or duties imposed upon this transaction by the applicable jurisdictions. You agree to abide by the terms agreed upon with other Members while utilizing this Website. You also agree that any information or content that you post or transmit through this Website will not be considered your confidential information. You grant Us an unlimited license to use, reproduce, display, edit, copy, transmit, process, control, publicly perform, create derivative works, and communicate to the public or any third party any such information and content on a world-wide basis within this Website. You further agree and consent to the Expert’s chats or transcripts, being captured in any format, controlled, processed and shared by Us with third parties as designated solely by Us. You also agree that all interactions between you and other Members are billed through this Website regardless on how the interaction is made.
this Agreement does not make either party the partner, joint venture, agent, legal representative, employer, or employee of the other. Neither party shall have or act as having any authority to make any statements, representations or commitments of any kind, or to take any action, that shall be binding on the other, except as provided for herein or authorized in writing by the parties to be bound.

C. Security & Privacy

This Website is committed to protecting your security and takes our responsibilities regarding the security of your information transmitted through or to this Website very seriously. To prevent unauthorized access and use of your information, We employ a high standard in maintaining the security of your personal data and follow strict security procedures in the storage and disclosure of your information.

Payments using your credit card, debit card or other payments are secured by the payment processor so that this information cannot be read as they travel over the internet. To prevent unauthorized access and use of your information, We do not store or pass through sensitive payment information such as your credit/debit card numbers or the password or the PIN numbers or the identification of other payment methods as they are directly dealt with our third-party payment processor. Our third-party payment processor may change from time to time and We require that you check their security procedures to ensure that they are compatible with your circumstances. This payment processor will be visible at the time you enter the transaction and you have the option to reject the services provided by it. However, if you reject the payment processor, you will not be able to conduct the transaction.
By registering and using the Website, you consent to the use of, disclosure of or Us processing personal information that you provide to Us so that we can efficiently provide your services or requests, enhance the services we provide to you, provide the information about this Website's new features and services and process your personal data in our servers using any appropriate means including cookies. This Website and the Experts will never ask you to reveal any personal information beyond the registration point for users or registration and application points for Experts, unless you re-register or request to change your personal data stored in our server. Although We encourage you to report to us any breach from the Members whenever this occurs, We are by no means responsible or liable for any actions that are conducted by the Members.

D. Our rights

We respect your privacy and will not disclose any personal data or any information transmitted to or through our Website except for matters described in this Agreement. However, if required by law, regulation or government or if We, at our discretion, believe that such disclosure is necessary for the continual operation or survival of this Website, or if We, at our discretion, believe that this is for the benefit of the Members, We may disclose any content, communication or information of any kind without prior notice.
We may, without prior notice, remove parts or all your information, content, course or any materials that you have sent to our Website or suspend, cancel any payments due to you if We believe, at our discretion, that you have violated any part of this Agreement. In addition, We may terminate or suspend your access to parts or all the Website without prior notice if We, at our discretion, believe that you have violated any part of this Agreement.

E. Intellectual Property Rights

Title, ownership rights and intellectual property rights of the materials in Website, except materials provided by third-party providers, the Experts or the Members, remain with Us. Such materials include, but not limited to, content, designs, text, graphics, compiled software, underlying source codes together with the compilation, collection, arrangement and assembly of any parts of this Website. This Website is protected by international copyright treaties.
This Website does not own, endorse, promote materials or check the intellectual property rights provided by the Members. Under no circumstances shall this Website be responsible or liable for any issues that arise due to any intellectual property conflict.
If you believe that your work has been infringed in a way that constitutes intellectual property rights infringement, please provide Us a statement by you, under penalty of perjury, that you are the legal owner and you have a good faith belief that the disputed work is not authorized by the legal owner, its agent, or the law along with a description of the infringing material, its source, location, information about the infringer, and your contact details (including your email).

F. Termination

This Agreement is effective as soon as you use this Website until this Agreement is terminated by either you or Us. If you no longer agree to be bound by this Agreement, you must cease using this Website by leaving the Website and deleting parts or all copies of this Website in your hardware. We reserve the right to suspend or deny, at our discretion, your access to part or all of the Website or deactivate or delete your account and all related information, contents and files and prohibit any further access to them. You agree that under no circumstances will this Website be liable to you or any other parties for the termination of this Agreement.

G. Disclaimer

The facilities, contents and services in this Website (hereafter collectively referred to as "Service") is provided on an AS IS basis, without warranty of any kind, including without limitation the warranties of merchantability, fitness for a particular purpose and non-infringement. The entire risk as to the quality and performance of the Service is borne by you. Should the Service prove defective, you and NOT Us assume the entire cost of any service and repair. You indemnify Us or any third-party provider for any effects caused by it. We take no responsibility for supplementing, updating or correcting any third-party or information about this Website or its Members. You also agree that We have no responsibility and no liability for the conduct, services, availability, advice, content, advertising, products or other materials given by the Experts, third-party services or the Members. We and this Website are in no way sponsored, endorsed or associated by or with any third-party providers, Members or Experts.

You acknowledge and agree that all the information provided by this Website or by the Experts (collectively referred to as "the Content") is for general informational purposes only. You acknowledge that the Content is obtained from sources believed to be reliable and that no guarantees are made by Us or the third-party providers to its accuracy, completeness, timeliness, privacy, security, legality. The advice given by this Website or its Members shall not be regarded as a replacement or substitute to the expert or authoritative advice or face-to-face advice that you should obtain in any other way.

WE WILL NOT BE LIABLE FOR ENFORCING ANY AGREEMENTS MADE AMONG ITS MEMBERS. IN THE EVENT OF A DISPUTE REGARDING ANY TRANSACTION CONDUCTED THROUGH THIS WEBSITE, ALL PARTIES HEREBY RELIEVE US FROM ALL MANNER OF ACTIONS, CLAIMS OR DEMANDS AND FROM ANY AND ALL LOSSES, DAMAGES, COSTS OR EXPENSES, INCLUDING, WITHOUT LIMITATION, COURT COSTS AND ATTORNEYS' FEES.

Fees

Free of charge for members

This Website does not collect charges for registering, being a member, depositing funds, consulting the Experts or taking courses. However, the Experts may charge you for participating in a course or consulting them. All live consultations are free for the first 3 minutes, regardless whether the consultation is free or for-pay.

If the Expert requires you to pay for his/her services:
For offline consultation, a user is charged by an Expert whenever the Expert has submitted the service that the user asked. For live consultation, the user is charged by the Expert as soon as the initial 3 free minutes passed. For courses, a user is charged as soon as the user enrolls in a course.

Withdrawal Fees

All Members will pay charges when withdrawing funds. For each withdrawal, the charge is $1.30 + 4.33 % of the amount to be withdrawn.

Fees for Experts

Experts are given the freedom to set their live and offline consultation fees and their course fees.
We charge fees to the Experts for using the facilities of this Website.
Experts are charged 10% of the course fee each time a user enrolls in a course.
For offline consultation, an Expert will be charged 10% of the offline consultation fee each time the Expert delivers the services as agreed by the Expert and the user.
For live consultation, Experts pay a flat low-cost fee of $0.14 per minute after the initial 3 free minutes, unless the Expert does not charge any fee to the customer. The Expert pays $0 to this Website for this pro-bono service.
